Disability planning includes getting a healthcare power of attorney to name an agent to make decisions on your behalf should you become incapacitated. A Living Will provides end-of-life care instructions for your agent. These documents require careful consideration of your values and making choices about heavy topics.

Choosing a Healthcare Agent

A healthcare power of attorney allows you select you someone you trust to serve as your healthcare agent should you become incapacitated and unable to make your own healthcare decisions. You select the powers you want to convey on this agent. You grant them access to your medical records and allow them to speak to your medical team of providers. They may be given the authority to make medical decisions such as to operate or not, to choose a certain type of treatment, refuse treatment, select your living arrangements and caregivers and choose medications.

Living Will ​

In your Advance Directives, or Living Will, you state your preferences for different types of treatment. During the interview process at Triangle Estate Lawyers, we go over the options in detail. Your healthcare agent appointed under the healthcare power of attorney will use the Living Will to drive decisions made on your behalf.

Quick Access in an Emergency

We offer two options to make your documents available to those who need access in an emergency:

  1. We file your healthcare POA and living will with the North Carolina Secretary of State on your behalf. They maintain a database and provide you with a wallet card with login credentials to access the database.
